Ex-FBI director charged after career prosecutor removed

A federal grand jury in the Eastern District of Virginia returned an indictment on Sep. 25, 2025, charging James ComeyJames Comey with one count of making a false statement and one count of obstruction of a congressional proceeding.

The charges relate to Comey's oral testimony before the Senate Judiciary Committee on Sep. 30, 2020.

The grand jury considered three proposed counts and declined to return one of them; the final indictment contains two counts.

Lindsey HalliganLindsey Halligan, sworn in as the U.S. Attorney for the Eastern District of Virginia days before the indictment, announced the charges and presented the case to the grand jury.

The case is assigned to U.S. District Judge Michael S. Nachmanoff, and federal court dockets show initial scheduling including an arraignment set for Oct. 9, 2025.

Erik Siebert resigned as U.S. Attorney for Eastern District of Virginia amid internal pressure related to politically sensitive investigations.
