Internal report contradicts DHS claims that Pretti wanted to "massacre law enforcement"
Two federal agents fired their weapons during the fatal shooting of Alex Pretti on Jan. 24, 2026, according to a CBP Office of Professional Responsibility report sent to Congress on Jan. 27. A Border Patrol Agent discharged a Glock 19 and a CBP Officer discharged a Glock 47.
The report does not say Pretti reached for, drew, or brandished his firearm. This contradicts DHS Secretary
Kristi Noem's claims that Pretti was brandishing a weapon and wanted to inflict maximum damage and massacre law enforcement.
According to the report, an agent yelled He's got a gun! multiple times. Approximately five seconds later, both agents fired at Pretti. The report states that after the shooting, an agent advised he had possession of Pretti's firearm.
Video evidence verified by multiple news organizations shows an agent removing Pretti's gun from his waistband roughly the same moment shots were fired. Pretti had a valid Minnesota concealed carry permit.
The incident began when a CBP officer pushed two women blowing whistles out of the roadway. One woman ran to Pretti, who put his arm around her. The officer pepper sprayed both Pretti and the woman before agents tried to take Pretti into custody.
Multiple Republicans including Sens. Ted Cruz and Lisa Murkowski criticized Noem's characterization of the shooting. Sen. John Fetterman called for Trump to immediately fire Secretary Noem.
Border Patrol Commander
Gregory Bovino was stripped of his title and is expected to return to California before retiring. DHS Secretary Noem met with Trump at the White House for nearly two hours on Monday, Jan. 26, 2026.
